Regular session of New Boston Village Council was called to order at 6:30 p.m. James Warren, Jr., President of Council, presided over the meeting. The roll was called with the following members of council being present: Mr. Fetty, Mr. Williams, Mr. Payton, Mr. Mills, Mrs. Newman and Mr. Salyers.
Pledge of Allegiance/silent prayer
Mr. Mills made a motion to accept and file the minutes from November 17, 2009. Mrs. Newman seconded the motion. Mr. Fetty asked the minutes to be corrected to read his statement suggesting ordinance no. 111.01 be changed to read requested ordinance no. 111.01 be changed. Mr. Mills made a motion to amend the minutes. Mr. Payton seconded the motion. All members concurring, Mr. Warren declared the motion carried 6-0.

James Warren, Mayor - Judy Tolbert will be retiring as of December 27, 2009. The Service Department is still working on patching potholes. Breakfast with Santa will be this Saturday, December 5, from 9 a.m. to 11 a.m.

Walter Lytten - discussed changes on section 111.01 of the codified ordinance regarding changing of council meeting time. Will have 1st reading later.
Steve Hamilton, Village Administrator - absent
Theda Aldridge, Income Tax Director - absent but had report for November, 2009. Mrs. Newman made a motion to accept and file the report. Mr. Mills seconded the motion. All members concurring, Mr. Warren declared the motion carried 6-0.
Darrold Clark, Chief of Police - Officer Powell is back to work. WSAZ visited today and filmed some of the officers regarding the toy drive for the kids and he hopes it will air today at 5:00 p.m. Arrest was made for the break-in at DESCO. Mr. Mills made a motion to accept and file the report. Mr. Salyers seconded the motion. All members concurring, Mr. Warren declared the motion carried 6-0.

Reading of Ordinances and Resolutions:
A third reading was given to an ordinance creating a one-half hour parking zone in the 3900 block of Gallia Street in the Village of New Boston. Mr. Mills moved Ordinance No. 42-09 be adopted. Mr. Salyers seconded the motion. All members concurring, Mr. Warren declared the motion carried 6-0.
Second reading was given to an ordinance authorizing a contract for legal services with Walter C. Lytten, attorney-at-law, from January 1, 2010 until December 31, 2010, and authorizing the Mayor to execute said contract on behalf of the Village of New Boston. Mr. Payton moved to accept the second reading. Mr. Mills seconded the motion. All members concurring, Mr. Warren declared the motion carried 6-0.
Second reading was given to an ordinance authorizing legal services in the Department of Community Development for the New Boston Community Development Block Grant Program. Mr. Mills moved to accept the second reading. Mr. Salyers seconded the motion. All members concurring, Mr. Warren declared the motion carried 6-0.
Second reading was given to an ordinance for legal services for prosecution of Village cases heard in the Municipal Court. Mr. Mills moved to accept the second reading. Mr. Salyers seconded the motion. All members concurring, Mr. Warren declared the motion carried 6-0.
Second reading was given to an ordinance authorizing a contract for services with Certified Operations and Maintenance from January 1, 2010 until December 31, 2010; authorizing the Village Administrator to execute said contract on behalf of the Village of New Boston. Mr. Mills moved to accept the second reading. Mr. Payton seconded the motion. All members concurring, Mr. Warren declared the motion carried 6-0.
Second reading was given to an ordinance authorizing the Village Administrator to enter into a contract to provide technical assistance with community and economic development projects and potential projects at the direction of the Village of New Boston with Leighty & Snider, Inc. Mr. Mills moved to accept the second reading. Mr. Salyers seconded the motion. All members concurring, Mr. Warren declared the motion carried 6-0.
An ordinance was read appropriating amounts in the various funds of the Village and declaring an emergency. Mrs. Newman moved the rules requiring an ordinance or resolution of a general or permanent nature involving the expenditure of money be read on three separate dates be suspended. Mr. Salyers seconded the motion. The roll was called. The voting results are as follows: ayes-6. Mrs. Newman moved to adopt Ordinance No. 43-09. Mr. Payton seconded the motion. The roll was called. The voting results are as follows: ayes-6.
First reading was given to an ordinance amending section 111.01 of the codified ordinances of the Village of New Boston, Ohio. Mr. Mills made a motion to accept the 1st reading. Mr. Fetty seconded the motion. The roll was called. The voting results are as follows: ayes-6.
New Business:
Mr. Salyers - asked if SOPA could change the flag at Bob Walton Park. Asked if joint jurisdiction with Portsmouth for traffic light at River Avenue. Mr. Lytten stated he did not know any way that would be possible, but he would check into it.
Mr. Payton - Shirley Conn's retirement party went well and wished her luck. Reported he, Eric and the Mayor had attended the pain clinic meeting in Wheelersburg and would like to hold a similar meeting in New Boston.
There being no further business, Mr. Mills moved the meeting be adjourned. Mrs. Newman seconded the motion. All members concurring, Mr. Warren declared the meeting adjourned at 6:50 p.m.
